Schillings client Jacob Zuma awarded damages and apology from the Guardian

Schillings client Jacob Zuma, the president of South Africa, has won very substantial damages after a libel case against the Guardian newspaper following false allegations printed earlier this year.

On 6 March 2009, the Manchester-based newspaper published an article that falsely claimed President Zuma was guilty of rape, corruption and bribery. President Zuma began legal action against the daily newspaper earlier this year claiming defamation, saying the article was grossly false and indefensible.

After being taken to court, the Guardian has apologised to the ANC leader and agreed to pay very substantial damages as well as cover legal costs.

In a statement read in the High Court on 30 July 2009, Schillings solicitor Jenny Afia described the allegations as being "of the utmost seriousness and totally untrue". She went on to explain that: "In light of the facts that the [Guardian] is now willing to pay very substantial damages and it has publicly apologised to [President Zuma], [President Zuma] considers that his reputation in this matter has been entirely vindicated and he is prepared not to proceed any further in his action against the [Guardian]."

Speaking from Mahlambandlovu last night, the president’s official residence in Pretoria,
President Zuma said: "What was said was extremely serious, not just for me but for the ANC. I am very pleased that the Guardian has now apologised. I firmly believe in press freedom and freedom of expression. I have fought for these and other basic rights my whole life and I will continue to support this. We had to take action in this matter because the publication crossed the line. Media around the world are obliged to exercise their freedom of speech in a responsible manner."

The TV debate shambles. Exactly WHAT is Lord Mandelson up to?

Why DID Lord Mandelson suggest a Brown-Cameron televised debate without first, apparently, checking with Gordon Brown?

Iain Dale asked the following highly pertinent question: “According to The Times, Gordon Brown has firmly shut the door and slapped down our very dear First Secretary of State. Does Mandelson feel so powerful now that he feels he can just freelance on issues like this without even having discussed it with the man formerly known as the Prime Minister?”

Does Mr Mandelson feel that powerful? Or does Mr Mandelson have a different agenda?

“You see, I only mentioned a perfectly reasonable idea of the Prime Minister taking part in a televised debate with David Cameron, the leader of the opposition, and look what happened? Brown started hurling his Nokia about again! I worry about poor Gordon. I really do. After all, surely he can't be that scared of Cameron that he is too frit as Thatcher would say, to appear in a televised debate with him?

“People are beginning to whisper that Gordon has lost the plot. Not me, you understand, but others. 'If he can't stand the heat, perhaps he should leave the kitchen' is what one minister said to me. Go North, Young Man! Go VERY North...

Ice Warrior Training Parry StraitVeteran Explorer, Jim McNeill, Announces the Search for Ice Warrior Expedition Members ~

Defined as the furthest point from land on the Arctic Ocean and therefore its centre, the Northern Pole of Inaccessibility remains the last truly significant place in the Polar Regions, yet to be reached by mankind. It is over two hundred miles further than the Geographic North Pole and one of four recognised north poles.

Jim is looking for 28 highly dedicated and committed people to take part in a comprehensive and intensive training programme to take on one of four 200 mile legs, pushing the route across the Arctic Ocean.

Along the route “crucial datasets” will be gathered to benchmark the condition of the ocean for the NASA funded National Snow and Ice Data Center (NSIDC) scientists, led by Walt Meier. These deliver the reality of climate change and make the whole expedition worthwhile and purposeful.

The journey itself is a complicated logistical problem with the need for highly remote fuel and food caches to enable the exchange of teams and resupplies.

Wedding debts outlive marriage by five years

Couples borrow on average £26,000 to fund their weddings, which can take 16 years to pay off. Unfortunately the marriage only lasts 11.5 years."

Loved-up couples are waltzing up the aisle with a £20,000 ball and chain of debt strapped to their ankles, only to be marching straight to the divorce courts a meager 11.5 years after they say I Do – leaving them paying off their nuptials long after the ink is dry on the decree absolute.

Research reveals that a whopping £113 million was borrowed during the first four months of this year to fund fairytale weddings and back in 2005 this figure was an eye-watering £467 million. With repayments of up to £26,000 (including interest rates) couples are left forking out for the big day for 16.5 years – 5 years longer than the marriage itself!

Poor credit rates and rising unemployment don’t seem to be deterring loves young dream either. Despite a national, personal debt of over £1.4bn, couples are continuing to splash the cash on grand weddings. Love must be blind if couples are borrowing up to £26,000 (including interest rates) to pay for their big day - it’s over £2,000 more than the UK’s national average salary. It’s a big price to pay for a pitiful 11.5 years of marriage that your Grandparents would be ashamed of.

Paying back the loan at a recommended rate of 5% per annum lumbers cash strapped couples with monthly repayments of £130, or £1,560 a year. Before the recession came along, a wedding loan was just another debt to add to the pile for a lot of credit-happy young Britons. With huge mortgages, shiny new cars and wallets crammed with credit cards, 5% repayments over a longer term were the only affordable option.

After 11.5 years when the love is lost and the divorce proceedings are well and truly underway, the marriage may be dust but the repayments aren’t so easy to forget. An outstanding balance of £8,060 is all that’s left of the nuptials, which will take a further credit crunching 5 years to pay off. All of this is ludicrous to think that a wedding certificate can be bought with the change in your back pocket - £3.50.

Divorces are also set to rocket this year as the recession tightens its grip and rows escalate over money. A third of current inquiries to lawyers by those deciding to break the knot are linked to the credit crunch - so much for ‘richer and poorer’!


Starting married life in debt places a strain on the marriage and the pockets of those involved, massively reducing its chance of survival. Wedding’s don’t have to cost the earth and can be enjoyed on a budget. Hays Social Housing reports increase in demand for housing professionals

Hays, leading specialist recruiter, has stated that the government's plans to secure a brighter future for school leavers amid the rising tide of unemployment, has led to an increase in demand for support workers.

"We are experiencing a steady demand for social housing jobs, particularly for support workers to undertake varying assignments with the 16-25 age group and this requirement is expected to increase as government grants for supported funding become available," said Matt Lewis, Business Director at Hays Social Housing. Support workers typically assist individuals in hostels and refuges with their lives and the transition back to work. This means the skills employers are looking for include proven experience with client groups and an ability to undertake support plans.

In line with the government initiative, Hays Social Housing has been partnering with social housing providers to offer careers advice to tenants and youngsters that are at risk of being made homeless. "We've been running a series of workshops with a focus on how to create a winning CV and how to conduct yourself during an interview. The sessions have had a positive impact, helping to break down some of the barriers that are preventing individuals from fulfilling their true potential," explained Lewis.

The recession, which has brought hardship to many families, has also fuelled an increased demand for specialist help for those at risk of having, or who have had, their homes repossessed. "The demand for housing advice officers has increased significantly over the past few months. Salaries have remained stable given the increased competition for skills to attract the best applicants, as pressure for these services continues to increase," continued Lewis.

Due to the changing regulatory framework, one of the key trends has been the increased focus of housing associations on their customer service provision, which has led to a requirement for tenant and community engagement, neighbourhood involvement and inclusion. In addition the Decent Homes Programme continues to fuel tenant liaison opportunities with organisations such as contractors, building and utilities companies' officers. Meanwhile, there is also a demand for housing policy roles that focus on strategy and commercially-minded individuals who can drive efficiencies and generate new business.

"Housing associations are looking for individuals with transferable skills to work as leasehold officers, liaising with private landlords and carrying out risk assessments," added Lewis.

Two of the key requirements for individuals in social housing jobs are a solid work history and an ability to hit the ground running. While CIH qualifications are important, particularly for senior roles, these are not usually a pre-requisite. The demand for social housing professionals is likely to continue given the pressing need to increase the supply of affordable housing, as highlighted by the government's commitment to build new homes, which is a continuing sign that the sector remains buoyant.

ServiceMaster to help fight off Swine Flu

Research finds Brits spend a quarter of a billion hours a year working on holiday

New research from Hotels.com has revealed that relaxing on holiday should be easy, but more than half of British travellers (55%) find it hard to switch off from work and rely on their laptops and Blackberries to keep in contact with the office.

Hotels.com research has revealed that in tough economic times, people are finding it harder than ever to switch off, and want to feel they are at work even when they are not. On a one week break, Brits now spend the equivalent of one day in the office (seven hours on average) which means that just under a quarter of a billion hours are lost each year by travellers working when they are supposed to be relaxing on holiday.

The new research established that there are three types of holiday workers. Of those who admit to taking time out of their holidays to work, 26% are emergency browsers - checking in only to deal with urgent issues; another 24% are sun lounger surfers who check in with the office at least every other day; and 35% are compulsive mailers who feel the need to be in constant contact with the office, logging on at least once a day or more.

Hotels.com found that 60% of those who work on holiday are doing so for reasons relating to their job security. While 28% felt that beach emailing "saved time when back in the office" and 12% wanted to ensure their colleagues were coping without them. The rest admitted it had more to do with job security, citing reasons such as "I want the office to see that I'm passionate about my job".

According to The Work Foundation, 'holiday guilt' can be explained by the UK's long-hours culture which gives rise to insecurity and 'presenteeism'. It is perceived that being seen and heard will lead to promotion and job safety, whereas those away from the office might miss out. Checking in with the office and not trusting others to look after things in their absence can be seen as an effort to show that they are indispensable.

Alison Couper, Communications Director for Hotels.com, said: ''Holidays are meant to be a time to relax and switch off from work. Designating a "blackberry hour", agreed with your partner, is one way of avoiding arguments but the ideal solution is to leave the office behind you and make the most of your holiday."

Swine flu floors Labour Candidate

Swine flu has put the Labour candidate for the Norwich North by-election in hospital. It is reported that Chris Ostrowski was taken so ill that he collapsed at his home and had to be taken to hospital for treatment.

The news has caused something of a stir as Mr Ostrowski had appeared with other election candidates at a live broadcast. Lord Mandelson has cancelled a planned visit to Norfolk as a result of Mr Ostrowski falling ill. And it is reported that Alistair Darling was in 'close proximity' to Mr Ostrowski, only hours before he (Mr Ostrowski) collapsed.

Regional roll out for Careers Website

Some questions on Swine Flu for the employer and employee

1. Is Swine flu a notifiable disease?
No. A notifiable disease is one listed in the Animal Health Act, or in an Order made under the Act.

2. If someone has swine flu (or is suspected of having it) is an employer legally allowed to bar someone from the workplace?
The answer may depend on the nature of the work, the length of the bar and on what grounds swine flu is suspected (if not confirmed).

Generally yes, a period of suspension should be allowed - , an employer is under a duty to provide a safe system of work for its employees and other workers.  An employer may be acting in breach of its duty of care to other staff (and customers etc) if it allows someone to attend work when they are known to be infected, or suspected to be infected with swine flu.  It is not clear how an employer would suspect a member of staff was suffering from swine flu, although as time progresses the symptoms may become more widely known (and differentiated from “normal” flu).
 
The employment contract may require the employer to provide work (e.g. piece work) or may be silent on the point.  The above health considerations should still apply, although the employer should consider alternatives, such as home working.

3. If they can, would the employer be obliged to pay the employees salary as the employee was absent from their workplace on the orders of the employer?

It depends on what the employment contract says – e.g. if not fit to attend work, even if not signed off by a GP, it may be reasonable for an employer to only pay sick pay (at SSP or enhanced levels, depending on contractual terms).  Otherwise, without the express contractual right to suspend without pay in such circumstances (it is unlikely such terms will exist, although force majeure/act of god clauses are not unheard of in employment contracts), the employee should be paid. 
 
Whilst failure/refusal to pay (absent a clause permitting such action) would normally be a fundamental breach of contract, that might not be the case with swine flu – Tribunals might take a pragmatic approach and treat swine flu as force majeure, a decision perhaps more likely if the employer’s action is seen as reasonable and proportionate (e.g. no pay for a couple of weeks, home working not possible, and consultation with employees, preferably in advance).
 
Why not pre-empt the situation by seeking agreement with staff now about how the business will deal with any such issues that arise?

Jon Shield to run the 200K Ultra Jungle Marathon!

Jon Shield BSc (Hons) Dip. PT (one of the UK’s most qualified Personal Trainers) will be running the 200K (125mile) Ultra Marathon through the Brazilian Rain Forest in Oct 2009.

The ultra marathon is one of the Worlds most enduring and physically challenging races, as each runner has to be self sufficient throughout the course, which includes carrying their own food, clothing, bedding whilst navigating the jungle and avoiding the critters that bite and can kill!

Jon will be running in aid of the British Heart Foundation after he was diagnosed with an irregular heart beat and had Electrocardioversion treatment.. From his initial diagnosis, Jon has gone from strength to strength in terms of his university degree and building his overall strength and fitness levels to peak condition.

Discussions are underway with the UK’s leading brands in terms of support and sponsorship opportunities, including British Airways, Nike, Canon and Asics.

During the final stages of training in September, Jon will be training daily at a special acclimatisation facility in Manchester which mirrors the Jungle conditions in terms of temperature and humidity levels.

Successful UK network to launch in Liverpool following £260,000 investment deal.

In a survey of over 600 Liverpool-based professionals aged 25 - 45, conducted by CitySocialising, results showed that over 85% of those who had moved to Liverpool within the last 2 years, arriving with no social network in place, found integrating into city life a "slow" and "difficult" process. Meeting new people in Liverpool, they commented, was “not as easy as they thought it would be.” 90% welcomed a service in Liverpool to help connect them with new local friends to explore the city's "fantastic" social and cultural scene with.

Plus, 58% of the local professionals in this age group that had lived in the area for more than 2 years, stated that they would be keen to find new friends in Liverpool to go out with outside their usual social and work circles. The main reasons given were because their friends were moving out of the city, were settling down and having children or simply because they had too little time to organise their social lives and that there was no easy way to meet new people from their local area within the city.

Throughout March and April 2009, CitySocialising, the UK's leading online and offline social network for outgoing professionals, embarked on the research-finding mission in Liverpool to find out about the views and experiences of young professionals in the city ahead of its plans to launch a network in the city in July 2009, following more than a quarter of a million pound investment deal.

4th of July. Time America joined the Commonwealth of Nations?

It's been a long time. But now, on 4th of July, 2009, it's time Britian told the European Union to 'spin on it' and took a much more active and positive role in the Commonwealth of Nations and invited the USA to join the Commonwealth.

Just imagine! Most of the free world would then be united under the banner of the Commonwealth of Nations! For such a giant market, the European Union would turn up with a begging bowl just to get to talk about trade with what would be the largest trading bloc in the history of the world!

Lawyers to pay claimants for pesonal injury work

A new website has been launched, which could revolutionise the way personal injury claims are handled in the future, resulting in the claimant being paid by the lawyer who takes on their case.

The Law Bazaar (www.thelawbazaar.com) has been set up by a solicitor with 20 years’ experience in personal injury claims in response to the ‘rip off’ schemes being run by claims management companies (CMCs) and insurers.

Costas Andrea, founder of The Law Bazaar and former equity partner at two top 100 law firms, commented, “Most people don’t realise that insurers make around £400 million each year solely by selling their own insured’s injury claims to their panel solicitors for up to £750 a time. The insurers and CMCs, appoint their own solicitors and arrange items such as medical examinations and vehicle hire – making money on each transaction. The person who is injured, however, sees nothing of the money accumulated by the insurers and CMCs but simply receives their damages.”

“I created The Law Bazaar to highlight the greed of insurers and claims farmers who are cashing in on the unsuspecting public. I wanted to help the claimant and the lawyer come together directly, with both benefiting financially. There is nothing that a claims management company does which the solicitor handling the case cannot do and therefore there really is no need to involve them in the process.”

Using The Law Bazaar, the claimant simply goes on to the website to register his or her injury case. An experienced personal injury lawyer will contact the claimant directly and pay £150 to The Law Bazaar when taking on the case. The lawyer, who is then around £600 better off than going down the traditional route of buying claims from insurers CMCs, is then in a position to offer some of this money to the claimant in addition to the damages relating to the case.

Instead I spoke on the phone to the triage nurse (in reality the fantastic and super-efficient senior nurse!) who, in consultation with the Swine Flu Helpline (a version accessible by medical staff only) decided that I should be given a prescription for Tamiflu. I then had a visit from a doctor (dressed in gloves and mask!) who took throat and nose swabs. He would then have to take them to the laboratory at the hospital himself. He test my wife at the same time.

I feel like crap, so might not be updating Thats News for a while. The services of Dr Jack Daniels may be called upon, I feel...
